This Privacy Policy explains how ODISEI MUSIC S.L. ("we," "us," or "our") collects, uses, stores, protects, and shares your personal information when you use the Odisei Play web or mobile application and related services (collectively, the "App").

1. Information We Collect

We collect information to provide and improve the Odisei Play App and your music learning experience. The types of information we collect include:

• Account Information: When you register for an account, you voluntarily provide your name, email address, username, and optionally, password.
• Music Learning & Practice Activity Data: We collect data related to your practice sessions and music learning progress, including MIDI information about notes played, notes missed, and related performance metrics. This data is collected to provide you with a personalized experience, usage statistics and to track your progress.
• Usage Data: We collect information about how you interact with the App, including the features you use, the amount of time you spend in the App, and your progress through lessons and exercises. This helps us better understand global user behavior and improve the App for everyone.
• Device Information: We collect information about the device you use to access the App, such as the device type, operating system, and unique device identifiers.
• IP Address: We collect your IP address, which is a numerical label assigned to your device by your internet service provider, mainly to know the country from which you're using the app.
• Audio Input Data: When you use the App's learning and practice features, we may process audio input from your device's microphone to analyze your performance (e.g., pitch, rhythm, dynamics) and provide real-time feedback and scoring. This data is processed live for app functionality and is not stored by us.
• Payment and Transaction Information: When you subscribe to Paid Content or purchase in-app coins, we collect information necessary to process your transactions and manage your access to features, via our third-party provider, RevenueCat. This includes details of your subscription plan, purchase history, and the type of content unlocked. While we do not directly collect or store your full credit card details, this information is securely collected and processed by our third-party payment processor, Stripe on Web or relevant platform on mobile (Apple or Google), and linked to your user account to provide the service.

2. How We Collect Your Information

We collect information in the following ways:

• Directly from You: We collect personal data like your name, username, and email address when you voluntarily register for an account.
• Automatically: We automatically collect music learning & practice activity data, usage data, device information and IP address as you use the App.

3. How We Use Your Information

We use the information we collect for the following purposes:

• To personalize your music learning experience and provide tailored content.
• To track your progress and provide you with statistics and insights into your practice regularity and musical development.
• To provide, operate, maintain, and improve the Odisei Play App and its features.
• To communicate with you about your account, updates, and support inquiries.
• To provide technical support and troubleshoot issues.
• For analytics and research to understand user engagement, identify trends, and improve the App's functionality and content.
• To ensure the security and integrity of the App.

4. Cookies and Tracking Technologies

We use Posthog, an analytics platform, to track user usage and interactions within the App. This helps us analyze how the App is used and identify areas for improvement. While data is tracked, it is handled in a way that cannot be directly linked back to a single identifiable user within the analytics platform itself (anonymized data).

Our user data, including account information and practice data, is stored securely in a PostgreSQL database hosted by our third-party provider, Supabase.

5. How We Share Your Information

We value your privacy and do not sell your personal information in any ways. We only share your information to providers that allow us to serve the App's experience to you:

• Third-Party Service Providers:

We share information with third-party service providers who perform services on our behalf to support the operation of the App. This includes:

• Posthog for analytics (usage data). Data shared is handled in an anonymized manner within Posthog.
• Supabase for database hosting and authentication (account information, usage data, practice data). Supabase acts as our data processor. Data stored with Supabase is used only for internal app operations and technical support by our team.
• Netlify for web server hosting (relevant data for serving the web portion of the service, if applicable).
• RevenueCat for subscription management: When you make a purchase or subscribe, payment and transaction details (excluding full credit card numbers, which are processed by Stripe or Apple/Google directly) are shared with RevenueCat. This sharing is primarily for App Functionality (e.g., validating receipts, managing your subscriptions, and enabling access to purchased in-app content) and for Analytics (to understand purchase trends and improve our service through RevenueCat's dashboard features). This purchase history data is linked to your user account for the purposes of providing and improving the service. We do not use or share this data for tracking you across other apps or websites for advertising purposes
• Stripe payment processing: When you make purchases for Paid Content within the App on the Web, we utilize Stripe as our third-party payment processor. While we collect information required for billing, we do not directly collect or store your sensitive payment card details. Instead, this information is securely transmitted directly to Stripe for processing. Stripe acts as our data processor and is contractually bound to protect your information and use it solely for the purpose of facilitating your payments. We receive transaction-related data from Stripe to confirm and validate your purchases.

These providers are contractually obligated to protect your information and use it only for the purposes for which we provide it.

• Internal Use: Your data, including practice statistics, is used internally by our team to improve the App and provide technical support. Some data is shared back to you within the App to show your progress and statistics.
• Legal Requirements: We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court order or a request from law enforcement).
• Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred to the acquiring entity.

Important Notes:

We explicitly state that we do NOT share your data with Tency Music. Our collaboration with Tency Music is solely based on licensing their content for use within the App, as described in our Terms of Use.

We do NOT share your data for marketing or advertising purposes with any third parties.

6. Data Security

We take reasonable measures to protect your personal information from unauthorized access, use, alteration, and disclosure. We utilize secure authentication provided by Supabase and store data in their secure cloud infrastructure. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

7. Data Retention

We retain your personal information for as long as necessary to provide you with the App's services and fulfill the purposes outlined in this Privacy Policy. We may also retain data for a longer period if required by law or for legitimate business purposes. The data will be deleted after 30 days of the user deleting its account.

8. Your Data Rights

Depending on your location and applicable data protection laws (such as GDPR in Europe), you may have the following rights regarding your personal information:

• Right to Access: Request a copy of the personal information we hold about you.
• Right to Rectification: Request that we correct or update inaccurate or incomplete personal information.
• Right to Erasure ("Right to be Forgotten"): Request the deletion of your personal information, subject to certain exceptions (e.g., legal obligations). We will delete all your personal data from our systems, including backups within 30 days, unless there is a legitimate business interest to keep the data, such as to comply with legal obligations, to enforce agreements or to resolve disputes.
• Right to Restrict Processing: Request that we limit the ways in which we process your personal information.
• Right to Object to Processing: Request that we object to the processing of your personal information in certain circumstances.
• Right to Data Portability: Receive your personal information in a structured, commonly used, and machine-readable format and have the right to transmit that data to another controller.
• Right to Withdraw Consent: If we rely on your consent to process your information, you have the right to withdraw that consent at any time.

9. Exercising Your Rights

10. Age Limitation

The Odisei Play App is only intended for individuals who are 18 years of age or older. We do not knowingly collect personal information from children under the age of 18. If you are under 18, please do not use the App or provide any information to us. If we become aware that we have collected personal information from a child under 18 without appropriate legal consent, we will take steps to delete that information as soon as possible.

11. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or through a prominent notice within the App when you next open it, detailing the changes. Your continued use of the App after being notified of the changes will constitute your acceptance of the revised Privacy Policy.
